The On-line Service available at https://www.masterdieta.pl (hereinafter referred to as “the Service Provider”) is owned by Masterdieta.pl Grupa Kapitałowa Polski Sport Spółka z ograniczoną odpowiedzialnością Spółka Komandytowa having its registered office at ul. Legionów Polskich 9b, Dąbrowa Górnicza 41-300, entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000648919 , Tax Number 6292477509, National Business Registry Number (REGON) 365927346 , telephone number +48 790 342 343, email address kontakt@masterdieta.pl.

These regulations include the general rules and conditions of providing services on the Internet via On-line Service using the Service Provider's website, terms and conditions of concluding agreements via the On-line Service, terms and conditions of execution of agreements, rights and liabilities of the Customer and the Service Provider, and withdrawal from an agreement and complaints procedure.

§1 Definitions

  1. the On-line Service ;– – on-line services available at https://www.masterdieta.pl.

  2. the Service Provider  – Masterdieta.pl Grupa Kapitałowa Polski Sport Spółka z ograniczoną odpowiedzialnością Spółka Komandytowa having its registered address and office for service at ul. Legionów Polskich 9b, Dąbrowa Górnicza 41-300, entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000648919 , Tax Number 6292477509, National Business Registry Number (REGON)365927346.

  3. Product – a dieting program, delivered once, every day or every second day (according to the order) as a set which consist of from1 to 6 balanced meals.

  4. The Customer  – An individual, an incorporated entity, or an organizational unit without an incorporated status who is given a legal capacity by the law, who is using or intends to use the On-line Services available on the Website.

  5. Consumer  – An individual, an incorporated entity, or an organizational unit without an incorporated status who performs a legal act with the Service Provider which is not directly related with their business or professional activity. font>

  6. Service – e-services provided by the Service Provider via the On-line Services

  7. The Agreement – an agreement concluded remotely between the Customer and the Service Provider, a subject of which is an order for a Product placed by the Customer.

  8. The Customer's Account – information collection about the Customer (including address data and the record of their orders) existing in the Service Provider's data-communication system.

  9. Subscription Period – a period of time during which the Service Provider provides the Customer with a Product.

  10. Order Form – a form available via the On-line Service which enables to place an order.

  11. The Registration Form – a form available via the On-line Service which enables to create the Customer's Account.

  12. Business Day – any day from Monday to Friday with the exception of public holidays.

§2 General Provisions;lne

  1. The Service Provider undertakes to provide services to the Customer within the scope, and on terms and conditions stated in the Terms and conditions of Use.

  2. The Customer undertakes to use the On-line Service in compliance with the law and the principles of the community life.

  3. The Customer who decides to use the Service is obliged to comply with the regulations of the present Terms and Conditions of Use.

  4. The Customer agrees to the Service Provider's collection, storing and processing the Customer's personal data in order to perform the Service. The detailed terms and conditions of collecting, processing and protecting personal data can be found in “Privacy Policy” of the On-line Service.

  5. Any prices given on the On-line Service website are in Polish złoty (PLN); they are gross prices including any taxes.

§3 Services and terms of providing services

  1. The Service Provider provides, by means of the On-line Service, the following services:

  3. Enabling to place orders for Products by means of the Order Form.

  4. The services specified in section 1 are free of charge.

  5. The Agreement with the Customer for the Service specified in section 1(a) shall be concluded upon a correct registering by means of the Registration Form by the Customer.

  6. The Agreement with the Customer for the Service specified in section 1(b) shall be concluded for a fixed period upon proceeding to registration, and shall be suspended upon withdrawal from registration, or upon sending the completed form to the Service Provider by the Customer.

  7. Technical requirements necessary to use The service provided by the Service Provider:

  8. A multimedia device with the Internet access,

  9. An Internet browser with activated Cookies and Java Script,

  10. Access to e-mail.

  11. The Customer shall pay any fees related to the Internet access and data transfer in accordance with the tariff of their Internet service providers.

§4 Terms of Registration

  1. A Customer's Account can be possessed only by a Customer who performed a correct registration.

  2. To register, a Customer, having completed the Registration Form, must send the Registration Form to the Service Provider. During the registration process, a Customer must give the e-mail address for further contact, and creates a password which enables the Customer's Account access.

  3. The Customers account is active immediately after the registration. A customer is allowed to have only one Customer's Account.

  4. A Customer is allowed to use only their own Customer's Account.

  5. A Customer is obliged to maintain secrecy and not to pass any details which would enable the access to the Customer's Account to third parties.

  6. The customer is obliged to use only their own personal data which is accurate. The Customer shall update any personal details given in the Customer's Account whenever they change.

  7. The Customer is obliged to use the Website only with data regarding his or her person and consistent with the actual state of affairs, and in the event of a change of data, he is obliged to update them in the Service.

§5 Product purchase

  1. The Service Provider shall enable the Customer to place an order for preparation and delivery of the Product during the Subscription Period in accordance with the order.

  2. The Service Provider offers the following products:

    2. WEGEMASTER – 1000 kcal/1500 kcal/2000 kcal/2500 kcal;

    3. BEZ LAKTOZY – 1000 kcal/1500 kcal/2000 kcal/2500 kcal;

    4. FITMASTER BEZ RYBY – 1000 kcal/1500 kcal/2000 kcal/2500 kcal;

    5. WEGEMASTER Z RYBĄ – 1000 kcal/1500 kcal/2000 kcal/2500 kcal;

    6. PALEOMASTER – 1000 kcal/1500 kcal/2000 kcal/2500 kcal/3000 kcal;

    7. 3PAKMASTER – Fit/Paleo;

    8. SPORTMASTER – 2000 kcal/3000 kcal/4000 kcal;

    9. Dieta dr Dąbrowskiej – 800kcal;

    10. Koktajlmaster – koktajlmaster;

      The menu for the above Products is presented in the Service 2 days in advance, where the Service Provider reserves the right to any changes in the menu in case of lack of any particular ingredients.

  3. The Service Provider reserves the right to extend the range of Products. Extending the range of products specified in section 2 shall not constitute an amendment to the Terms and Conditions of Use, mentioned under §12 section 2.

  4. The Service Provider enables to place orders:

    1. By telephone on +48 790 342 343 Monday to Friday between 8.00 am To 6.00 pm, Saturday and Sunday between 8.00 am to 2.00 pm.

    2. By e-mail at kontakt@masterdieta.pl 24 hours 7 days a week,

    3. By use of The Order Form available on the On-line Service 24 hours 7 days a week.

  5. To place an order the Customer indicates a Product offered by the Service Provider, stating a type of diet program , energy value of meals being a part of the Product, and a period of during which the Product will be supplied (Subscription Period). Additionally, The customer provides any details necessary to fulfill the order including the personal data and delivery address.

  6. After receipt of the order, the Service Provider sends a confirmation of the order approval,which is also a confirmation of the order, by e-mail to the address given during the order placement. The contract shall be considered concluded upon receiving the confirmation of the order approval by the Customer.

  8. The customer has the right to report objections to the content of the order confirmation within 12 hours of receiving the message from the Service Provider. Failure to raise objections within the specified time limit means acceptance of the terms of the order.

§6 Order processing time and delivery

  1. An order placed on business days from Monday to Friday by 1.00 pm shall be fulfilled on the business day subsequent to the day of the order placement with the exception of Fridays, where orders placed until 1.00pm shall be fulfilled on the first Saturday subsequent to the day of the order placement. An order placed on Saturday throughout the day and on Sunday by 1.00 pm shall be fulfilled on the business day subsequent to the date of order placement. An order placed on a business day after 1.00 pm shall be fulfilled on the second business day subsequent to the date of order placement, with the exception of Friday, where an order placed after 1.00 pm shall be fulfilled on the business day subsequent to the date of order placement. An order placed on Sunday after 1.00 pm shall be fulfilled on the second business day subsequent to the date of order placement. Any placed orders shall be fulfilled after the payment has been made before 1.00 pm (a transfer must be made through Dotpay.pl or a bank transfer confirmation must be sent to the Customer Service's e-mail address kontakt@masterdieta.pl).

  2. The time 1.00 pm specified in section 1 is the deadline and indisputable time.

  3. The Customer must not change the delivery address after 1.00 pm. If the delivery address is changed after 1.00 pm, the Service Provider will deliver the Product to the address given before 1.00 pm.

  4. If the Customer chooses the option for Saturday/Sunday delivery in the Order Form, the Product (meals for both days) is delivered only on Saturdays. There is not delivery service on Sundays. It is possible to order the Product only for Saturdays or only for Sundays.

  5. Delivery service may be provided on public holidays. The Service Provider may schedule deliveries for other days than standard ones, that is for any days except Sundays. The Customer shall be informed about such changes accordingly by e-mail or by telephone.

  6. It is possible for the Customer to determine preferable delivery time, however the Service Provider reserves the right to deliver the Product at the time different than the time preferred by the Customer, within the time frames from 2.00 am to 10.00 am.

  7. Referring to the Act of the Protection of Personal Data, the Service Provider delivers Products in paper bags marked with the Customer's address data.

  8. The Service Provider reserves the right to discontinue or reject the fulfillment of the order in the following cases:

    1. The order has been placed incorrectly, in a way preventing its fulfillment;

    2. It is ineffective to determine a delivery address with the Customer;

    3. Failure to pay for the ordered Product by the Customer;

    4. Gross violation of these Terms and Conditions of Use by the Customer.

  9. The Product shall be delivered by the Service Provider to the address indicated by the Customer during the order placement process.

  10. The Product shall be delivered at the time agreed with the Customer.

  11. Cost of delivery in the towns and cities listed on the Service Provider's website is included in the Product price determined in the Price List available on the website of the On-line Service. Delivery cost shall be individually agreed with the Customer in the case where a placed order is for delivery to a town/city which isn't listed on the Service Provider's website.

  12. The Service Provider reserves the right to settle a new time or date of delivery with the Customer if the order fulfillment is infeasible at the originally agreed time or date for reasons beyond the Service Provider's control.e.

  13. The Customer has the right to suspend deliveries during the subscription period after prior notification to the Service Provider by use of e-mail or telephone. The notification must be passed to the Service Provider 1 business day in advance by 11.00 am. The subscription period will be extended for a number of days equal to the number of days on which the delivery has been suspended.

  14. Order fulfillment shall not constitute any grounds for accepting legal responsibility by the Service Provider for potential Customer's adverse condition, or their body's negative reaction to any ingredients of the Product, in particular due to the Service Provider's lack of awareness of other drinks and foods consumed by the Customer.

  15. If the Customer fails to collect the order due to absence of the person entitled, or due to any other circumstances not reported by 1.00 pm on the day preceding the delivery, or incorrect delivery address, the product shall be deemed effectively delivered. In such a case The Customer is not entitled to claim reimbursement of the part of the sum corresponding to that day, or to any claims for not having received the Product.

  16. In the occurrence of unforeseen factors, which arose through no fault of the Service Provider (e.g. atmospheric conditions, decisions of government services etc.), causing difficulties or preventing delivery, The Service Provider shall not be liable for failure to deliver the Product, and the Customer does not have the right to a complaint, refund or compensation.

  17. W In the event of theft of a package with the Product which has been delivered to the Customer , the Service Provider shall not be liable for failure to deliver the Product. The Customer does not have the right to a complaint, refund or compensation. Delivery of the Product is recorded by taking a photograph by the service Provider.

  18. In the event of cancellation of the package order, compliant with the valid offer of the Service Provider, The Customer is obliged to make a payment for the partially used dieting program at the price of single days catering.

  19. In the event of exchanging a dieting program into one of a higher price during the order period, the Customer is obliged to make a compensatory payment by 1.00 pm on the preceding day.

§7 Methods of payment

  1. The Service Provider enables the following methods of payment:

    1. Traditional bank transfer to the Service Provider's bank account in PKO Bank Polski, account number: 67 1020 2498 0000 8802 0616 3952 ,

    2. On-line bank transfer, credit card or debit card payment through Dotpay.pl

    3. In cash to the courier on the first day of delivery

  2. A payment for the ordered Product must be made for the full amount within 3 days from the order confirmation date. In the event of the Customer's failure to make the payment, the order shall be canceled.

  3. The day of payment shall be considered the day on which the amount due is credited to the Service Provider's bank account, or the day on which a confirmation of on-line bank transfer is sent in to the Service Provider. The confirmation must be in PDF or JPG format, and must include the Customer's data and order number.

  4. The Service Provider is relieved from their obligation of issuing a receipt to the Customer, in accordance with §2 (1) of the Ordinance of the Minister of Finance of 04.11.2014 concerning the exemption of obligation to keep records by using cash registers.

§8 Withdrawal from the Agreement for services provided electronically

  1. In the case of agreements for continuous services and for an indefinite time provided electronically (e.g. the service specified in §3(1)(a) of these Terms and Conditions of Use), the Customer has the right to withdraw from an agreement.

  2. The Customer may withdraw from the agreement mentioned in §8(1) at any time upon giving notice with immediate effect, and without providing reasons. In order to terminate the contract, the Customer must send a relevant statement to the Service Provider's e-mail address.

  3. The statement mentioned in§8(2) may be supplied by the Customer in accordance with the template being appendix 1 to these Terms and Conditions of Use.

§9 Withdrawal from the Agreement for the Product delivery

In accordance with §38(38)(4) and (12) of the Act of 30 May 2014 on consumers' rights, the Customer who is a Consumer does not have the right to withdraw from the agreement, which is mentioned in §27 of the above Ac.

§10 Complaint procedures

  1. In the case of non-fulfillment or undue fulfillment of services provided electronically by use of the On-line Service by the Service Provider, the Customer is entitled to make a complaint by e-mail to kontakt@masterdieta.pl . A correctly filed complaint must contain the Customer's identification (name and surname or company name, residential address or company address, and e-mail address), a subject of the complaint, photographic documentation, time period subject to the complaint, and circumstances justifying the submission of the complaint. The complaint must be submitted within 7 days from the date of non-fulfillment or undue fulfillment of services. The complaint shall be examined by the Service Provider within 14 calendar days from the date of the complaint submission.

  2. Any complaint concerning execution of the Agreement the subject of which is the Product shall be placed within 24 hours from the date of the event giving rise to such a complaint, with the exception of a complaint concerning non-fulfillment of delivery – in such a case the complaint must be placed by 12.00 noon on the day of delivery scheduled. The complaint shall be examined by the Service Provider within 7 calendar days from the date of the complaint submission, with the exception of the delivery complaint, which shall be examined immediately.

  3. If the time limit for the complaint submission, specified in §10 (1) and (2), is exceeded by the Customer, the complaint shall not be examined. The Customer shall be informed of thereof by the Service Provider immediately.

  4. Refunds for accepted complaints are paid on business days, every Tuesday and Thursday.

§11 Liability

  1. The Service Provider does not take responsibility for entering incorrect data by the Customer, in particular by entering incorrect data in the forms available on the website, or for the Customer's activity which disturbs or prevents providing services by the Service Provider.

  2. The Service Provider reserves the right to suspend or terminate the provision of individual functionalities of the On-line Service for the purpose of conducting maintenance, inspection, and technical base development or software development. Suspension or termination of the provision of individual functionalities of the On-line Service must not affect the Customer's rights.

  3. The Service Provider reserves the right to block the registered Customer's account in the case of infringement of these Terms and Conditions of Use, using the Service in a way contrary to its purpose or in non-conformance with the binding laws. The Customer's account remains blocked for a period of one month.

  4. The Service Provider reserves the right to delete the Customer's account, in the case where, after the Customer's account has been blocked, the Customer continues infringements specified in §11(3).

  5. The Service Provider shall inform the Customer about taking measures specified in §11(3-4) at least one day in advance presenting grounds for blocking or deletion of the Customer's account.

  6. Blocking or deletion of the Customer's account does not cause suspension or termination of the order fulfillment in accordance with the subscription period.

§12 Out-of-court procedures and rules of handling complaints and claims;

the Customer who is a Consumer is entitled to the following out-of-court procedures and rules of handling complaints and claims:

  1.  By requesting the settlement of the dispute arising from the conclusion of the Agreement using the assistance of the Permanent Consumer Arbitration Court running at the Trade Inspectorate;

  2. By requesting the conduct of a mediation procedure for arbitration of the dispute between the Customer and Masterdieta.pl by the Provincial Inspector at the Trade Inspectorate;

  3. By free assistance in arbitration of the dispute between the Customer and Masterdieta.pl provided by the District (Municipal) Consumer Ombudsman or a community organization involved statutorily in consumer protection (e.g. Federation of Consumers, Association of Polish Consumers). Counseling offered by Federation of Consumers is provided at toll-free helpline number 800 007 707, and by Association of Polish Consumers at porady@dlakonsumentow.pl

  4. By submitting a complaint by use of the UE Internet service ODR available at http://ec.europa.eu/consumers/odr/.

§13 Final Provisions

  1. Copyrights and intellectual property rights on the website of the On-line Service as a whole and its elements (including content, graphics, works, patterns, layout of web pages and logotypes) are the property of the Service Provider or other authorized third parties and are subject to copyright protection. The use of the content thereof, other than in cases allowed by the applicable rules of law, without the Service Provider's express consent in writing will result in civil and criminal liability.

  2. The Service Provider reserves the right to introduce any amendments to these Terms and Conditions of Use. The Service Provider shall inform the Customer about such amendments at least 7 calendar days prior to the entering into force of these amendments. The amendments to the provisions of Terms and Conditions of Use shall not apply to The Customers who placed their orders within the term of the previous version of the Terms and Conditions of Use.

  3. For any matters not regulated herein, the relevant provisions of the Polish law shall apply

  4. The Customer who is a Consumer is entitled to use out-of-court procedures for arbitration of the dispute, and to pursue claims through mediations or by use of the arbitration court. Notwithstanding the above, the customer may seek assistance from the District (Municipal) Consumer Ombudsman. Any necessary information may be obtained on the website of the Office of Protection of Competition and Customers at www.uokik.gov.pl.

  5. Disputes arising from provision of services under these Terms and Conditions of Use shall be subject to settlement of the court of general jurisdiction as per the choice of the Customer in accordance with the applicable rules of Polish law..

  6. These Terms and Conditions of Use shall enter into force 1 May 2017.
